Premium Terms – SELLMyCODE

These Premium Terms apply exclusively to paid products (source code, templates, assets, scripts, and other digital items) purchased from SELLMyCODE . For free items, please see our Free Items Policy. For general rules, see our Terms of Use.

By purchasing a premium item, you agree to these Premium Terms. If there is a conflict between these Premium Terms and our general Terms of Use, these Premium Terms take priority for premium items.

1. What Are "Premium Items"?

Premium items are any products listed on our website with a price greater than $0.00 or explicitly marked as "Premium", "Paid", or "Pro". This includes one‑time purchases, subscription‑based products, and extended license options.

2. License Types for Premium Items

When you purchase a premium item, you are granted a license. We offer two standard license types:

a. Standard License (Single Use / Regular License)

Permitted for: One single end product (website, app, or project) owned by you or your client.

You may: Use the item in one project, modify it, and combine it with your own work.

You may not: Use the same item in multiple separate projects (unless you purchase additional licenses). Resell or redistribute the item in raw form.

Typical customers: Freelancers, small business owners, developers building one site.

b. Extended License (Multi‑Use / Unlimited)

Permitted for: Multiple end products (unlimited projects) or for products that will be sold (e.g., a template you include in a SaaS product you sell).

You may: Use the item in unlimited projects, incorporate into commercial products you sell, and allow end users of your product to interact with the item (but not extract it).

You may not: Resell the item as a standalone digital asset.

Typical customers: Agencies, SaaS companies, marketplace sellers.

Note: The exact license type (Standard or Extended) is specified on each product's page before purchase. Some premium items may have custom licenses (e.g., GPL, MIT) – those override these terms.

3. Technical Support for Premium Items

Premium items come with technical support as described below:

What support includes:

Answering questions about installation, configuration, and basic usage.

Helping resolve bugs or compatibility issues (within reason).

Providing guidance on modifying the item (does not include custom development).

What support does NOT include:

Customisation or new feature development.

Server administration, hosting setup, or third‑party software issues.

Teaching coding basics (HTML, CSS, JavaScript, PHP, etc.).

Support channels & response time:

Response time: Within 24‑48 hours on business days (Monday–Friday).

Support duration: 6 months from purchase date (renewable with an optional support extension).

4. Updates & Version Policy

Premium items receive free updates for a minimum of 12 months from the purchase date. Updates may include:

Bug fixes and security patches.

Compatibility updates for new PHP versions, frameworks, or browsers.

Minor feature improvements (new versions may increase the version number, e.g., v1.2 → v1.3).

Major version upgrades (e.g., v1.x → v2.0) may require a discounted upgrade fee if the changes are substantial. You will be notified before any paid upgrade is required.

After the 12‑month period, you may continue using the last downloaded version indefinitely, but you will no longer receive automatic updates unless you purchase a support & updates extension (available in your account dashboard).

5. Pricing & Payment

Currency: All prices are listed in [USD/EUR/other] and exclude applicable taxes (VAT, GST, etc.) unless stated otherwise.

Payment methods: Credit/debit cards, PayPal, [other gateways].

Taxes: You are responsible for any taxes applicable in your jurisdiction. For EU customers, VAT may be added based on your location.

Price changes: We may change prices at any time, but changes do not affect previous purchases.

6. Refunds for Premium Items

Refunds are governed by our Refund Policy. In summary for premium items:

Eligible for refund: Corrupted file, misrepresented product, duplicate accidental purchase (within X days).

Not eligible: Change of mind, incompatibility due to your server setup (unless not disclosed), lack of technical skill.

Premium items are not subject to a "free trial" or "money‑back guarantee" unless explicitly stated on the product page.

7. Pre‑Sales Questions

If you are unsure whether a premium item fits your needs, please contact us before purchasing:

8. Account & Download Access

After purchasing a premium item:

The item appears in your account dashboard under "Downloads".

You may re‑download the item at any time (even years later) as long as your account is active.

If you lose access due to account issues, contact support.

Do not share your download links or account credentials with others – that violates our license terms.

9. Source Code & Customization

You have full access to the source code of any premium item (unless it is an encrypted or compiled product, which we will clearly state). You may:

Modify the code to suit your needs.

Combine it with your proprietary code.

You may not:

Obfuscate or minify the code and then claim it as your original work.

Remove copyright or license notices if required by the item's license (some third‑party components may require attribution).

10. Liability & Warranty for Premium Items

Premium items are provided "as is" but with the following limited warranty:

We warrant that the item will materially conform to its description for 30 days after purchase.

We do not warrant that the item is error‑free, bug‑free, or compatible with every possible environment (though we make reasonable efforts).

If a defect is found within 30 days, we will either:

Fix the defect and provide an updated version, or

Offer a full refund (your choice).

After 30 days, our general limitation of liability applies (see Terms of Use). In no event shall our total liability exceed the amount you paid for the premium item.

11. Transferring a Premium License

You may not transfer a premium license to another person or entity unless:

You have not used the item in any project (unused license).

You request a transfer within 60 days of purchase.

We approve the transfer in writing (email).

Licenses that have been used in a live project are non‑transferable. If you sell a website or app that includes our premium item, the new owner inherits the right to use that specific instance, but they may not re‑download the item or receive support under your original license.

12. Subscription‑Based Premium Items (if applicable)

If your website offers subscription plans (monthly/yearly) for access to premium items:

During active subscription: You may download and use any premium item included in your plan.

After cancellation: You lose access to download new items, but you retain the right to use items downloaded during the subscription period (per the license of each item).

No prorated refunds for unused subscription time.

13. Violation of Premium Terms

If we reasonably believe you have violated these Premium Terms (e.g., reselling a premium item as a standalone product), we may:

Revoke your license immediately.

Suspend or terminate your account.

Pursue legal action and claim damages.

We also reserve the right to blacklist your domain or email address from future purchases.
